6.1. Online Waiver Standards

Arctic offers the ability to accept electronic signatures for liability waivers and other agreements for tours operated within the United States. This can increase efficiency by making it simple for guests to complete their waivers before they arrive and easing the filing and record keeping burden. This can also help save time devoted to tracking completion and submission of waivers, because Arctic will record when waivers have been completed and this information can be easily pulled into trip rosters so you know who still needs to complete their waivers before the trip can depart. In addition, paper waivers can be scanned and stored in Arctic as well. Online waivers also make it simple to search for and retrieve waivers when they are needed. 

Arctic's online waiver feature was designed with the following specifications in mind:

1. The waiver program satisfies the requirements of both US Federal ESIGN and most State-specific regulatory requirements.

2. The program records a unique customer identifier, a copy of the waiver as signed and a date/time stamp that is encrypted and unalterable.

3. Users can opt-out, requesting a paper copy of the waiver.

4. Users can specify that they are a parent or legal guardian signing on behalf of a minor.

5. All waivers are stored for at least seven years and can be retrieved at any time. Industry standard disaster recovery protocols are in place should they ever be needed.

These specifications will generally satisfy most State and local laws as well as meet the requirements of most insurance companies. However, it is recommend that you check with both your lawyer and your insurance provider to be sure that the specifications above meet all requirements aid out by both your local jurisdiction and your insurance provider.
